1) Who we are
These Terms & Conditions (“Terms”) govern your access to and use of the websites, extensions, packages, and related services operated by WUUNU AI spółka z ograniczoną odpowiedzialnością(“Wuunu”, “we”, “us”, “our”).

2) Scope & relationship with the EULA
These Terms cover the Wuunu websites, documentation, and our developer tools currently distributed as: (i) IDE extensions for VS Code, Cursor, Windsurf, and other compatible editors; and (ii) an npm front‑end package (together with any future distribution methods, the “Services”). The extensions and npm package include their own End User License Agreement (EULA) inside the distribution. If there’s any conflict, the EULA controls the license to the software; these Terms govern your use of the Services (e.g., website, accounts, integrations, and policies).
3) What Wuunu does (and what it does not)
Wuunu is a developer tool that helps you visually configure and update AI‑powered app features using your own third‑party AI subscription(s) (e.g., model/API providers). We do not provide base models or their outputs and we do not bill you for model usage. You are solely responsible for all charges from your chosen providersand for compliance with their terms and policies.
4) Experimental software & risk acknowledgement
Wuunu is experimental, may contain bugs, and may change at any time. Using Wuunu can alter code, configuration, repositories, prompts, and other project assets. You must review and validate all proposed changes and outputs before applying them and you are responsible for maintaining adequate backups, version control, and safeguards. To the maximum extent permitted by law, we assume no liability for any mistakes, defects, corruption, regressions, security issues, downtime, or other problems in your codebase, repositories, infrastructure, or data arising from or related to your use of the Services, including any commits, pull requests, migrations, or configuration changes generated, suggested, or applied through the Services.
5) Accounts, credentials, and your responsibilities
- You may need a Wuunu account for certain features. Provide accurate information and safeguard your credentials.
- You configure and control third‑party provider keys/tokens. Only use credentials you are authorized to use.
- You are responsible for your configurations, prompts, datasets, code, and any data you process with the Services.
6) Your content & feedback
- Ownership. You retain all rights to code, prompts, datasets, outputs, and other materials you upload or generate (“Customer Content”).
- Model training. We are not an AI model provider; any training/retention settings for your content are governed by your chosen providers.
7) Third‑party services & distribution platforms
The Services integrate with or are distributed through third‑party services (e.g., the VS Code Marketplace, Cursor marketplace, Windsurf extension channels, npm, CI/CD, cloud model APIs). Those services are subject to their own terms and privacy policies. We do not control and are not responsible for third‑party services, their availability, security, pricing, or outputs.
8) Open‑source components
The software may include open‑source components licensed under their respective licenses. Where there is a conflict, the open‑source license governs the relevant component. Notices are included in the distribution.
9) Privacy
Your use of the Services may involve processing personal data. Do not upload personal data unless you have a lawful basis and have implemented appropriate safeguards. For privacy questions, contact support@wuunu.com.
10) Fees & taxes
We may offer free or paid features for the Services separate from any third‑party provider charges. We will disclose Wuunu fees (if any) before you incur them. You are responsible for all third‑party provider charges and any applicable taxes.
11) Availability & support
The Services are provided without service‑level commitments and may be changed, suspended, or discontinued at any time. Support is provided on a discretionary, reasonable‑efforts basis via support@wuunu.com.
12) Disclaimers
- No professional advice; outputs may be incorrect. AI outputs and suggestions surfaced through the Services (via your providers) can be inaccurate, incomplete, or inappropriate. You must review and validate before relying on them.
- “AS IS” / “AS AVAILABLE”. To the maximum extent permitted by law, the Services are provided without warranties of any kind— express, implied, or statutory—including merchantability, fitness for a particular purpose, non‑infringement, and availability.
- Third‑party services. We make no warranties regarding third‑party services, platforms, models, or networks.
13) Limitation of liability
To the maximum extent permitted by law, Wuunu’s aggregate liability for all claims arising out of or related to the Services is limited to PLN 100. We are not liable for indirect, special, incidental, consequential, exemplary, or punitive damages, or for lost profits, savings, data, goodwill, business interruption, or replacement of goods/services.
Nothing in these Terms excludes liability where such exclusion is prohibited by law (e.g., for fraud or intentional misconduct).
14) Indemnity
You will defend, indemnify, and hold harmless Wuunu and its personnel from any third‑party claims and related costs (including reasonable legal fees) arising from: (a) your misuse of the Services; (b) your breach of these Terms; (c) your violation of law or third‑party rights; or (d) your integrations with third‑party services.
15) Suspension & termination
We may suspend or terminate your access immediately if you materially breach these Terms, create security/legal risk, or where required by law. You may stop using the Services at any time. Sections that by their nature should survive (including 4, 6–14, 16–18) survive termination.
16) Export controls & sanctions
You represent that you are not located in, under control of, or a national/resident of any country or territory subject to comprehensive embargoes or sanctions and are not on any restricted‑party list. You will not export, re‑export, or transfer the Services in violation of applicable export or sanctions laws.
17) Changes to these Terms
We may update these Terms at any time. It is your responsibility to review the Terms for updates. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

19) Miscellaneous
- Entire agreement. These Terms, the EULA inside the extension/npm distribution, and any referenced policies constitute the entire agreement regarding the Services.
- Severability; no waiver. If any provision is unenforceable, the remainder remains in effect; failure to enforce is not a waiver.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or asset transfer.
- Governing law & venue. Except where prohibited by mandatory law, these Terms are governed by Polish law, and disputes will be resolved by the competent courts in Kraków, Poland.
